Welcome to Vorail AI. These Terms of Use ("Terms") are a legal agreement between you and Pixtas, LLC ("Vorail," "we," "us," or "our") governing your access to and use of the Vorail AI mobile application and related services (collectively, the "Service"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Vorail AI is a voice-based social community built for the global blind and low-vision community. Members ask questions, share answers, and connect with one another through their voices. The Service is operated by Pixtas, LLC.

2. Eligibility

You must be at least 16 years old to use the Service, or the minimum age required in your country or region to use a social networking service, whichever is greater. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Accounts

To use the Service you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use of your account.

4. Subscriptions, Billing, and Trials

Access to the Service requires a paid subscription, offered as auto-renewable subscriptions through the Apple App Store:

• Monthly subscription: 9.99 USD per month, including a one-week free trial for eligible new subscribers.
• Annual subscription: 99.99 USD per year, including a one-month free trial for eligible new subscribers.

Prices may vary by region and are shown in the app before purchase. The following terms apply to all subscriptions:

• Payment is charged to your Apple Account at confirmation of purchase.
• Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period, at the rate then in effect.
• You can manage your subscription and turn off auto-renewal in your Apple Account settings after purchase.
• Any unused portion of a free trial period is forfeited when you purchase a subscription, where applicable.

Subscriptions are handled by Apple. Refunds are subject to Apple's policies, and requests should be directed to Apple. We do not process payments or store your payment information.

5. User Content

The Service allows you to record and share voice content, questions, answers, and other materials ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant Pixtas, LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and make your User Content available to other members as part of operating the Service.

You are solely responsible for your User Content and represent that you have the rights necessary to share it and that it does not violate these Terms or any law.

6. Acceptable Use

You agree not to use the Service to:

• Harass, bully, threaten, abuse, or harm other members.
• Post or share content that is unlawful, defamatory, obscene, hateful, or otherwise objectionable.
• Impersonate any person or misrepresent your affiliation with any person or entity.
• Share another person's private or identifying information without consent.
• Distribute spam, solicitations, or unauthorized advertising.
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.

We reserve the right, but are not obligated, to review, moderate, and remove User Content, and to suspend or terminate accounts that violate these Terms, in order to protect the community.

7. Content Moderation and Reporting

We are committed to keeping Vorail AI a safe and welcoming space. Members can report content or other members who violate these Terms. We may remove content, mute, block, or remove members at our discretion to maintain the community.

8. Intellectual Property

The Service, including its software, design, and branding, is owned by Pixtas, LLC and protected by applicable intellectual property laws. Except for your own User Content, you may not copy, modify, distribute, or create derivative works from the Service without our written permission.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we handle information. Please review it at https://vorail.com/privacy/.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. Any peer support, community resources, or information shared through or in connection with the Service is provided by community members and is not professional, medical, legal, or other advice.

11. Limitation of Liability

To the maximum extent permitted by law, Pixtas, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months preceding the claim.

12. Termination

You may stop using the Service and cancel your subscription at any time through your Apple Account settings. We may suspend or terminate your access to the Service if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ends, though certain provisions of these Terms will survive.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide notice through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of law principles, except where local consumer protection law requires otherwise.
